Chairman of Parliament’s Appointments Committee, Bernard Ahiafor, has dismissed the petition filed against Supreme Court nominee Justice Kwaku Tawiah Ackaah-Boafo, describing it as legally baseless and lacking merit.
Justice Ackaah-Boafo, who appeared before the Committee for vetting on Friday, June 20, 2025, had his appearance initially delayed after a petition was submitted by one Anthony Kwabenya Rau.
The petitioner alleged that the nominee had insulted and disrespected him during a court proceeding, reportedly calling him “arrogant” and “power drunk.” The nominee has firmly denied the claims.
However, in his opening remarks at the vetting on Friday, June 20, 2025, Ahiafor stated that after a thorough review of the petition and the associated court judgment, the Committee found no grounds to support the accusations.
“The allegations contained in the petition—that the judge insulted and attacked the petitioner—are completely unfounded,” he said.
“Having considered the totality of the evidence and the judgment, the Appointments Committee cannot become a substitute for the Supreme Court or the Judicial Council to review a Court of Appeal ruling or take disciplinary action,” he said.
Mr. Ahiafor explained that the case in question—Adolf Xavier Ghana Limited v. DVLA—was already addressed through proper judicial channels, with the petitioner having exercised his right to appeal.
The petitioner also submitted additional documents to the committee, which were reviewed.
However, these turned out to be related to a separate corruption petition filed against a judicial official, Charles Idan, and not connected to Justice Ackaah-Boafo.
“The additional documents have no bearing on the current petition and are entirely unrelated to the nominee,” Ahiafor clarified, adding “We see no justification to admit them as evidence against him.”
Describing the complaint as “frivolous, vexatious, worthless, and unmeritorious,” the Committee Chair concluded that it was “a complete abuse of the process.”
“The complaint against the nominee is about the exercise of Judicial power in conducting the matter leading to the judgment under reference. The committee this morning ruled that the petition is frivolous, vivacious, worthless, unmeritorious, and it is baseless in law and fact. It is a complete abuse of the process,” he stated.
Justice Ackaah-Boafo is the final nominee in a list of seven Court of Appeal justices put forward by President John Dramani Mahama for elevation to the Supreme Court.
