Kpandai rerun: Judge cynically manipulated burden of proof – NPP

The National Youth Organiser of the New Patriotic Party (NPP), Henry Nana Boakye, popularly known as Nana B, has criticised the High Court judge who ordered a rerun of the Kpandai parliamentary election, describing the ruling as unjust and flawed.

Justice Emmanuel Bart Plange Brew of the High Court in Tamale ordered the Electoral Commission (EC) to conduct a rerun of the parliamentary election in the Kpandai constituency. Following the decision, Parliament on Monday, December 8, 2025, formally notified the EC of a vacancy in the seat.

Addressing journalists in Accra on Tuesday, December 9, Henry Nana Boakye accused the judge of improperly handling the burden of proof in the case.

He argued that the court’s ruling amounted to judicial overreach rather than a fair interpretation of the law.

According to him, the court failed to hold accountable the petitioner, who claimed to be involved in acts of vandalism that led to the relocation of the collation centre during the election.

He also took issue with the court’s assessment of alleged irregularities.

“This is not interpretation; this is dictatorship from the bench. Clearly, in this case, you could see that the burden of proof was cynically manipulated by this judge. The court refused to find the petitioner who led the vandalism that forced the EC to relocate the collation center.

“Miraculously, when assessing the irregularities that affected the results, speculation became acceptable, vague, and unsubstantiated assertions were deemed sufficient. The petitioner produced no credible tally,” he said.

The High Court’s decision has sparked debate within political circles, with both major parties expressing differing views on its implications for the electoral process in the constituency.

The Electoral Commission is yet to announce a date for the rerun election.
