The High Court has struck out a petition filed by former Tertiary Education Institutions Network (TEIN) President, Haruna Rashid Yussif, challenging the outcome of the Student Representative Council (SRC) presidential election at the African University of Communications and Business (AUCB).
Mr. Yussif had gone to court seeking to overturn the election results that declared Miss Muniratu Mohammed winner of the SRC presidential race.
However, at the third sitting of the case, presiding judge His Lordship Emmanuel Kofi Diaba struck out the matter after ruling that the petitioner failed to provide sufficient evidence to support his claims.
The court also awarded a cost of GH¢5,000 against Mr. Yussif for wasting the court’s time.
“The application is struck out. Cost of GHS 5,000.00 is awarded against the Applicant in favour of the 4th Defendant,” the court’s ruling stated.
The election, which had attracted significant attention on the AUCB campus, saw Miss Muniratu Mohammed defeat Mr. Yussif by 12 votes to become the SRC President-elect.
Mr. Yussif subsequently challenged the outcome, alleging irregularities and asking the court to nullify the results and order a rerun.
The court proceedings, however, ended with the dismissal of the petition after the judge determined that the allegations were not backed by credible or substantial evidence.
The development marks the third setback for Mr. Yussif in his attempt to lead the AUCB SRC. Following the court’s decision, supporters of Miss Mohammed welcomed the ruling, while some members of Mr. Yussif’s camp expressed disappointment.
Miss Muniratu Mohammed is expected to be formally sworn in as the substantive SRC President of AUCB.
The case has also renewed discussions on the need for strict enforcement of electoral guidelines, particularly eligibility requirements, during student elections.
