Supreme Court Judge nominee, Justice Hafisatu Amaleboba, has proposed the introduction of a constitutional instrument (C.I.) to strengthen the enforcement regime around asset declaration by public office holders.
Her proposal came during her vetting before Parliament’s Appointments Committee on Wednesday, June 18, 2025, in response to a question from the Ranking Member, Alexander Afenyo-Markin.
The Minority Leader cited President John Dramani Mahama’s recent sanctions imposed on appointees who failed to declare their assets after a set deadline.
“What is your proposal regarding how to limit the president’s role in terms of ensuring constitutional fidelity in respect of his own appointees when enforcing this asset declaration law?” Afenyo-Markin asked.
Justice Amaleboba responded that the Constitution allows for the introduction of a C.I. to clarify and streamline procedures, including the sanctioning regime, which she believes is the most viable pathway to resolving the issue.
“The only limit I see under the Constitution since is the constitution is for a C.I. setting out guidelines. That is the only way I see a resolution to the problem,” she stated.
She explained that the ongoing constitutional review process provides a timely opportunity to introduce such an instrument, which would address ambiguities in the current framework and ensure that enforcement mechanisms are more predictable and legally sound.
