Transport consultant, painter sue Krowor MCE, demand his removal from office

Two residents in the Krowor Municipality have dragged the Chief Executive of the Assembly, Joshua Nii Bortey, to court.

The two, Nene Tetteh Kpentey, a transport consultant and Shaibu Ali, a painter, are seeking an interlocutory injunction to stop the MCE from carrying out any official duties until after the resolution of the case in court.

The case will be heard on Friday, March 22.

They are seeking a declaration that the confirmation of Mr. Bortey on January 9, 2019, is null and void.

The two are also seeking a declaration that makes all the decisions he took as MCE null and void.

They argued in their writ sighted by citinewsroom.com that the Assembly “did not follow the laid down procedure stipulated in the local governance Act 2016 with Amendment (Act 940) in the confirmation of the Municipal Chief Executive of the Assembly.”

“The said meeting convened on 9th January 2019 was not convened or presided over by the presiding member neither was the president’s members present at the meeting.”

Also added to the suit is the Coordinating Director of the Assembly, Emmanuel Abuanor Nortey.

The plaintiffs insisted that Mr. Nortey “exceeded his authority by organizing and convening a meeting of the assembly to confirm [Mr. Bortey].”

The plaintiffs maintain that “the defendants are adamant to flaunt the law and use their statutory duty and obligations to the community and unless and until a court of competent jurisdiction interferes to redress the situation, the mischief will continue.”

President Nana Akufo-Addo had to re-nominate Mr Bortey on three different occasions after previous rejections, which started in September 2018.

He had failed to secure two-thirds of the required votes of the assembly members.

There was some controversy when the meeting to confirm Mr. Bortey in December 2018 was cancelled due to some security concerns.

Some residents threatened assembly members because of the two previous rejections.
