TDC clarifies Community 23 land dispute, files appeal over court ruling

TDC Ghana Ltd has clarified that an ongoing land litigation involving the company, Trasacco Estates Development Company Limited and members of the Nii Tetteh Santeo family relates only to a 361-acre parcel of land occupied by Trasacco Estates and not the entirety of Community 23 as being circulated in some reports.

According to the company, the clarification follows media publications regarding a ruling delivered by the High Court (Land Division) in Accra in Suit No. LD/0059/2015 involving the Nii Tetteh Santeo family, Trasacco Estates Development Company Limited, TDC Ghana Ltd, and the Lands Commission.

In a statement signed by Management, TDC Ghana Ltd stressed that it still holds a valid judgment in its favour against the Nii Tetteh Santeo family in the case of Nii Blabi Din Borketey Nkpa v. TDC, Suit No. FAL/186/12, dated November 8, 2016.

The company explained that the judgment declared the whole of Communities 23 and 24 as part of the Tema Acquisition Area under the control and management of TDC Ghana Ltd, adding that the ruling remains valid and has not been overturned or reversed by any superior court.

Management further disclosed that the company has filed a Notice of Appeal to challenge the recent High Court ruling and will pursue all available legal remedies in accordance with the laws of Ghana.

“TDC Ghana Ltd does not intend at this stage to delve into the merits of the pending appeal, [but] urges the public to disregard misinformation, speculation and unauthorised claims relating to ownership of lands within Community 23 beyond the specific 361-acre area presently under litigation,” portions of the statement noted.

The company assured stakeholders and persons with interests in lands within the Tema Acquisition Area of its commitment to protecting lands under its management while acting within the confines of the law.

It also advised the public to exercise caution and conduct due diligence in relation to land transactions within the affected enclave.
