The Atwima Nwabiagya South Municipal Assembly in the Ashanti Region has given house owners a six-month moratorium to provide domestic toilet facilities or face prosecution.
The directive, contained in a notice signed by the Municipal Chief Executive, Mr Wisdom Osei Boamah, and made available to the Ghana News Agency, was approved at the Second Ordinary Meeting of the General Assembly held on Thursday, October 23, 2025.
Under the moratorium, property owners are required to install adequate toilet facilities between February 1 and July 1, 2026. The Assembly warned that its byelaws and other relevant legal instruments would be enforced against landlords who fail to comply.
The move is in line with Section 6(2)(a) of the Assembly’s byelaws, the National Building, Land Use and Spatial Planning Regulations, and the Local Governance Act, 2016 (Act 936), which mandates the provision of at least one functional and accessible domestic toilet facility to safeguard public health.
The Legislative Instruments further require property owners to obtain the necessary permits and approvals from the Municipal Assembly before undertaking any construction or renovation works, subject to periodic inspections to ensure compliance.
According to the Assembly, the decision is aimed at enforcing sanitation regulations and protecting environmental health and public safety within the municipality.
“The Assembly is committed to prioritising public health and safety and therefore works towards the attainment of Sustainable Development Goal Six on clean water and sanitation to promote good health and prevent epidemics in the municipality,” the notice stated.
